“Competition Organizer”)

3.
ELIGIBILITY
The Contest
is open to residents of the province of Quebec and Ontario who have reached the
legal age of majority on the date of registration.
Each
customer who makes a purchase in a Stéréo Plus store will automatically have a
chance to win the amount of their purchase including taxes, up to $2,500. A
participation will be granted for each purchase transaction made between
November 1 and November 30, 2023 in a Stéréo Plus store or at www.stereoplus.com.
No minimum purchase amount and no limit on the number of entries per purchase.
Any canceled or refunded transaction will be automatically excluded from The
Contest.
Excluded
are: directors, officers, executives, employees, agents, agents and representatives
of The Contest Organizer, its parent company, any company, trust or other legal
entity controlled by or related to them, Facebook if The Contest takes place on
Facebook, any participating Store, advertising and promotion agencies, suppliers
of prizes, goods and services within the framework of The Contest, as well as
members of the immediate family (brothers, sisters, children , father, mother,
legal or de facto spouse, notwithstanding their place of residence) of the
above-mentioned persons or the persons with whom they are domiciled (whether or
not they are related).
4.
PARTICIPATION / NO PURCHASE REQUIRED
To be
eligible for the “WIN YOUR PURCHASE – CRAZY Days of November” contest, no
purchase is required. However, to enter, you must write a handwritten letter of
at least 100 words explaining why you deserve to win the prize. Your request
must include a telephone number and a valid email address to contact you, and
be submitted by post before November 25, 2023 to the following address: WIN
YOUR PURCHASE of Jours FOUS de November, 1300 rue du Technoparc, suite 109 ,
Trois-Rivières, Quebec, G9A 0A9. Limit of 1 handwritten entry per person for
the duration of The Contest. If you have not made any purchases in one of the
Stéréo Plus stores during the contest period, and if chance made you the winner
of the contest, you will be entitled to an amount of $850 for yourself, and you
will be able to choose an NPO among the eligible NPOs to which will be given an
amount of $850. All other parts of the regulations apply equally. If an entry
letter has been submitted, and a purchase has been made, the amount of the
purchase will be used for the awarding of prizes.
5. PRICE
The winner
wins the total amount of their purchase up to $2,500 taxes included. An
equivalent donation will be made by Groupe Stéréo Plus inc. to the non-profit
organization chosen by the winner from the list of eligible NPOs.

7. PRIZE
CLAIM
In order to
be declared a winner, any selected participant must:
a) be
contacted by telephone or email, at the sole discretion of the Contest
Organizer, within ten (15) days following the draw. Any selected participant
who cannot be contacted following appropriate and reasonable steps taken by the
Organizer during this period will be disqualified, and a new draw will be
carried out to award the prize. In the event that a selected participant is
contacted by email, he or she must respond in accordance with the instructions
provided therein, if applicable. Any email notification of a prize followed by
a statement that the message could not be delivered will result in the
disqualification of the participant and the selection of a new participant;
b) have
answered correctly and without any assistance whatsoever, particularly
mechanical, to the mathematical skill-testing question;
c) upon
request and in a timely manner, provide photo identification;
d) the
prize will be sent to you within a maximum of 15 days following the end of The
Contest and receipt of your declaration and release form.
Failure to
comply with one of the conditions mentioned in these rules or to accept the
prize will result in the selected participant being disqualified. In such a
case, The Contest Organizer may, at its discretion, cancel the prize or carry
out a new draw from the remaining eligible entries until a participant is
selected and declared a winner. If no participant is declared a winner within
sixty (60) days following the original drawing, the prize will be forfeited.
Refusal to
accept a price. The refusal of a selected participant to accept a prize in
accordance with the terms of these rules releases The Contest Organizer from
any obligation related to this prize towards this person.
Awarding of
prizes. No prize will be awarded unless the winner has been confirmed. No prize
is transferable. It must be accepted as is without substitution in cash or
otherwise, except at the sole discretion of the Organizer. The Organizer
reserves the right to substitute a prize (or part of the prize) of the same
nature and equivalent value or, at its sole discretion, the monetary value of
the prize (or part of the prize) indicated in these regulations.
Prize Claim
Fees. Any costs or expenses incurred by the winner in connection with claiming
or redeeming a prize are the responsibility of the winner.
Limited
prices. In any case, The Contest Organizer cannot be required to award more
prizes or to award a prize other than in accordance with these regulations.
8. GENERAL
CONDITIONS
Disqualification.
All documents related to The Contest, including, but not limited to,
registration forms, scratch cards and Declaration and Liability Release Forms,
are subject to verification by The Contest Organizer. Entries containing errors
will not be eligible as well as those which are incomplete, illegible,
mutilated, fraudulent, damaged or containing a printing error or which have
been tampered with, modified, falsified, reproduced or obtained illegally.
Participants who do not comply with these rules may be excluded from this
Competition and from any competitions or promotions that the Organizer will
hold in the future, including, without limitation, any participant guilty or
suspected of having tampered with entry forms or materials, the processing of
entries, the conduct of The Contest or any technical or mechanical element of The
Contest, to have deliberately damaged the websites, Internet pages and applications
relating to this Competition or to have sabotaged the legitimate running of The
Contest, having violated these rules, for example, having used a means contrary
to these rules or likely to be unfair towards other participants (e.g.
registrations beyond the permitted limit) or having or acting unfairly or in
such a way as to harm or with intent to annoy, torment, threaten or harass
another person. The participant or any other person who deliberately attempts
to damage a website, equipment, application or technology used in The Contest
or to undermine the legitimate operation of The Contest commits a criminal
offense and a civil offense and the organizer reserves, in such a case, the
right to report this person to the legal authorities and to demand from this
person all the damages that the law allows him to claim.
Declaration
and waiver of liability form.
By
participating or attempting to participate in this competition, any entrant
selected for a prize releases from all liability The Contest Organizer, its
parent company, any companies, trusts or other legal entities controlled by or
related to them, all Stores participants, the Régie des alcools, des courses et
des jeux, Facebook if The Contest takes place on Facebook, advertising and
promotion agencies and suppliers of prizes, goods and services within the
framework of The Contest as well as all their directors, officers, owners,
associates, employees, agents, representatives, successors and respective
assigns (collectively the “Release Beneficiaries”) from all damages and all
liabilities relating to the Contest (participation, operation, announcement,
regulations, etc.) or relating to the price (complaint, use, etc.). In order to
be declared winners, selected participants will be required to sign the
Declaration and Release of Liability Form containing a declaration of
compliance with The Contest rules and confirming this waiver of liability in
favor of the Beneficiaries of the waiver.
Limitation
of liability. Without limiting the generality of the exemption above, the
Beneficiaries of the exemption release themselves from all liability relating
to (i) any typographical (or other) error contained in the offer or the
documents relating to the administration of The Contest , including, without
limitation, errors contained in advertising, official rules, winner
announcement, prize awarding or malfunction, problems or technical difficulties
experienced with networks, telephone lines, SMS messaging systems, any computer
component, any software or any communication line, in relation to the loss or
absence of network communication or in relation to any faulty, incomplete,
incomprehensible or deleted transmission by any computer, server or service
provider or any software, viruses, computer bugs, failure of personal computers
or configuration of software and hardware, or failed attempts to transmit any
email or other communications to the Contest Organizer or an entrant for a any
reason, including congestion on any network or failure of any site which may
limit the ability of any person to participate in The Contest; (ii) any late,
lost, stolen, delayed, unreceived, damaged, misdirected, incomplete or
inaccurate entries; (iii) any failure to receive entries due to transmission
problems or technical failures of any kind, including, without limitation, the
malfunction of any networks, servers, access providers, hardware or software
that whether attributable to the sender or the recipient who may limit or
prevent any person from participating in The Contest; (iv) any damage that may
be caused, directly or indirectly, in whole or in part, in particular to the
system or device of the participant or another person, by the downloading of
any Internet page or any software or otherwise and by the transmission any
information regarding The Contest.
Cancellation,
suspension or modification of The Contest. The Organizer reserves the right, at
its sole discretion, to cancel, terminate, modify or suspend, in whole or in
part, this Competition in the event that an event occurs that disrupts its
operation. progress, for example a difficulty in the computer system recording
all registrations, or any human interventions that may alter or influence the
administration, security, impartiality or progress of The Contest as provided
for in these regulations, and this, subject to the approval of the Régie des
alcools des courses et des jeux du Québec, if required.
End of
participation in The Contest. In the event that The Contest were to end in
whole or in part before the end of The Contest Period, the random draw may be
made, at the discretion of The Contest Organizer, from among the eligible
entries duly registered during The Contest. Duration of The Contest or, where
applicable, until the date of the event which ended The Contest.
Personal
information. By participating in the Contest, participants consent to the
collection, use and disclosure of their personal information by the Organizer
and/or its authorized agents for the purpose of administering the Contest and
awarding prizes. By accepting a prize, any winner authorizes The Contest
Organizer and its representatives to use, if required, their name, address
(city, province), voice, statements, photographs, images and other
representations and recordings, for advertising purposes, and this, in all
media, including, but not limited to the Internet, and this, without further
notice and without any form of remuneration. Any participant may be required to
sign a confirmation to this effect.
Intellectual
property and copyright. By submitting a photograph, musical piece, creation or
other type of work (the “Work”) as part of this Competition, the participant
guarantees that the Work is free of all third party rights and the participant
guarantees to hold the rights necessary to submit the work as well as, in
particular, but without limitation, to authorize the Organizer to use it,
modify it, transfer it, adapt it, broadcast it, communicate it or distribute
it, on any medium of
Property.
All information and documents related to The Contest, including, but not
limited to, registration forms, scratch cards, declaration and liability waiver
forms, information of a technical, technological or operational nature and
information relating to designs, computer systems, software, logos, trademarks
and intellectual property are and remain the exclusive property of The Contest
Organizer. None of this information and documents will be returned to
participants.
Participant
identification. For the purposes of these rules, the participant is the person
whose name appears on the registration form and it is to this person that the
prize will be awarded if they are selected and declared a winner. If a dispute
arises as to who submitted an entry form, it will be deemed to have been sent
by the authorized account holder associated with the email address provided at
the time of entry. “Authorized account holder” means the natural person who is
assigned an e-mail address by an Internet access or online service provider, or
other company assigning e-mail addresses for the domain associated with the
submitted email address.
Decision of
The Contest Organizer. All decisions of the Contest Organizer or its
representatives relating to this Contest are final and without appeal, subject
to any decision of the Régie des alcools, des courses et des jeux du Québec in
relation to all matters falling within its jurisdiction.
Dispute /
residents of Quebec. A dispute regarding the organization or conduct of an
Advertising Competition may be submitted to the Régie des alcools, des courses
et des jeux for a decision. A dispute regarding the awarding of a prize may be
submitted to the Régie only for the purposes of intervention to attempt to
resolve it.
Miscellaneous.
By participating in the Contest, participants agree to be bound by these
Contest rules and the decisions of the Organizer, which decisions are final and
binding in all respects, including, without limitation, decisions regarding the
eligibility or disqualification of entries as well as the awarding of a prize.
The Contest is subject to all applicable laws and regulations. Only selected
participants will be contacted. If any paragraph of these regulations is
declared illegal or unenforceable by a court of competent jurisdiction, then
that paragraph will be considered void, but all other paragraphs will remain
applicable.
