ELECTRONICS REPLACEMENT PLAN
This document and your purchase invoice state all the dispositions of this Protection Plan (Plan), sold by the retailer for the benefit of the Plan owner, and the obligations and services to be provided by Comerco Services Inc. (Comerco) for the product covered by this Plan. This Plan is administered by Comerco. Comerco deposits funds in a guarantee trust fund in order to cover future claims. This trust is also bonded in part by an insurance company.
COMERCO’S OBLIGATIONS AND COVERAGE:
1. At its discretion and in return for the fees applicable to this Plan, Comerco agrees to reimburse the purchase price of the covered product (excluding accessories) during the coverage period and in accordance with the terms and conditions of this Plan, provided that the claim is justified by a covered failure or manufacturing defect occurring under normal conditions of use.
2. Coverage includes damage due to power surges.
3. Following a covered failure, Comerco will replace peripheral items supplied with the covered product, including, but not limited to, remote controls, gaming controllers, speakers and 3D viewing glasses. Coverage for peripheral items begins at the expiration of the manufacturer’s warranty applicable to the specific item and ends when the Protection Plan’s period of coverage expires. Coverage is limited to one (1) replacement per peripheral item during the term of the Plan. Replacement of a peripheral item terminates coverage for that item.
4. Comerco’s maximum liability under this Plan shall not exceed the original purchase price of the covered product, as stated on the purchase invoice, excluding applicable sales taxes.
5. At Comerco’s discretion, when the covered product experiences a covered failure, Comerco will reimburse the original purchase price paid for the covered product, in accordance with the form of reimbursement described in Article 4, excluding applicable sales taxes. GENERAL CONDITIONS
6. The Plan becomes effective following the expiry date of the combined manufacturer’s warranty for parts and labour for the chosen term, as indicated on the purchase invoice, up to a maximum of five (5) years from the date of possession.
7. To qualify for coverage offered by the Plan, the covered product must be purchased as new and be covered by a repair warranty period of at least ninety (90) days. Failures must be reported during the coverage period of the Plan.
8. The Plan must be purchased before the end of the manufacturer’s warranty, or a maximum of one (1) year from the date of possession, whichever is shorter.
9. This Plan covers a single product only.
10. The maximum value of an in-store replacement credit is the price paid for the original product, as stipulated on the purchase invoice. This amount, excluding taxes, must not exceed $22,500. Please note that, if the price of the replacement product is less than the price of the original product, the difference will not be refunded. The replacement will be finalized by a Comerco authorized retailer.
11. From the moment a product has been replaced or a credit provided, Comerco will have met all its obligations and the coverage will become null and void for that specific product.
12. Upon authorization of a replacement claim, the Plan owner may be required to return the product using a prepaid shipping label provided by Comerco. If Comerco determines a replacement is warranted, the Plan owner will receive reimbursement up to the original purchase price, excluding applicable sales taxes.
13. This Plan is valid for products intended for use in a domestic single-family dwelling only. Products which are installed in common usage areas of a multi-unit dwelling cannot benefit from this Plan. In the case of a home business, only home daycares and private nursing homes are eligible for coverage under this Plan. Commercial or rental usage will render this Plan null and void and if no costs have been incurred by Comerco, the Plan owner may obtain a full refund of the Plan from the retailer. ARE EXCLUDED FROM COMERCO’S RESPONSIBILITY
14. DAMAGES CAUSED BY:
14.1. Failure to conform to the manufacturer’s recommended use or use in conditions for which the product was not intended.
14.2. External causes, rust, inappropriate use, inappropriate installation, abuse or improper hook-ups, abusive or improper manipulation, modification, an accident, a shock, a fall, chemical corrosion, damage that occurred during delivery, or data transmission problems. NOTE: Accidental Damage from Handling (ADH) is not covered under this Plan.
14.3. Sand, liquid or humidity infiltration, unless the product is explicitly specified by the manufacturer as being submersible.
14.4. Failures that are the subject of a manufacturer recall or service bulletin. Also, repairs, replacement parts or labour costs that are covered by a manufacturer’s warranty or an insurance policy.
15. THE FOLLOWING PRODUCTS OR COMPONENTS:
15.1. Garnishes, command inscriptions and gradations, any esthetical components, products or parts covered by a manufacturer’s warranty.
15.2. Warping or caving in of the structure.
15.3. Any part or component of a structural nature that does not affect the correct functioning of the product, such as, but not limited to: plastics, finishes, knobs and dials. 15.4. Parts that should be replaced or cleaned periodically under normal usage such as, without being limited to, bulbs, lamps, fuses, filters, batteries or ink cartridges.
15.5. Glass, adjustable legs, rollers, and handles damaged by external causes. Satellite antennas, cables, shelves, and drawers.
15.6. Any and all products with a tampered or absent serial number. In this case, the Plan will become null and void, without refund.
15.7. Burnt pixels in or on the screen surface and the replacement or repair of pixels beyond the original manufacturer’s guidelines.
15.8. Loss, theft, or unexplained disappearance of the covered product.
16. OTHER EXCLUSIONS
16.1. Odours.
16.2. Noise and product performance which are not caused by a failure.
16.3. Consequential damage, loss of use, revenue, salary and time due to delays resulting from the failure of the covered product, unavailability of parts, or any other difficulty or delay that Comerco may encounter in completing the required replacement.
16.4. Loss or appropriation by a third party of data left in a product that must be replaced. The Plan owner is entirely responsible for recovering their data. Configuration, data loss, viruses, any and all software/hardware updates required for correct functioning.
16.5. Costs related to the removal, disposal, delivery, installation or relocation of the original product or its replacement. The Plan does not cover any costs associated with the removal or restoration of any item obstructing access to the product.
16.6. Any repair, modification, alteration or improper handling performed by the Plan owner or by any unauthorized or unqualified service provider. Such actions may render the Plan null and void, without refund.
16.7. In the event of a failure affecting an item that is part of a pair or set, Comerco’s responsibility will be limited to the replacement of the failed item only.
16.8. Any and all pre-existing conditions known to the Plan owner that exist prior to the start date and that, within all reasonable probability, relate to the overall fitness of the covered product.
16.9. Any product delivered outside of Canada at the time of purchase.
AUTHORISATION AND OTHER PRECISIONS
17. TO OBTAIN A REPLACEMENT AUTHORISATION: A picture of the product, damage, serial number label, and a copy of the purchase invoice will be required online: www.comerco.com/servicerequest • The Plan owner must contact Comerco within thirty (30) days of the date of failure and within the coverage period of the Plan. The Plan owner will be required to answer a series of questions regarding the product failure, in order to obtain a replacement authorization.
18. CANCELLATION: Comerco may cancel the Plan at any time on the basis of fraud. The Plan owner may cancel the Plan for any reason, anytime within thirty (30) days of the date of purchase, provided no claims have been reported, and receive a full refund for the purchase price of the Plan from the selling retailer.
19. CONFIDENTIALITY: The Plan owner authorizes Comerco to provide their name, contact information and any information Comerco has on file to any third party wishing to offer a new Plan, any subcontractor mandated by Comerco to offer services directly or indirectly linked to the Plan, or any entity to which Comerco may assign, in whole or in part, its obligations under the Plan. Comerco may contact the Plan owner to offer services directly or indirectly related to the Plan.
20. TRANSFERABLE: This Protection Plan is transferable from one owner to another, without charge, by completing the online request at www.comerco.com/ownertransfer.
